OKLAHOMA CITY – A significant legislative measure aimed at improving communication and access to information for families experiencing pregnancy loss has made its way through the Oklahoma House of Representatives and is now headed to the Governor’s desk for final approval. Senate Bill 1436, authored by Rep. Cynthia Roe, R-Lindsay, aims to provide crucial support during one of the most challenging times in a family's life.
The bill stipulates that when a fetal death occurs in a hospital, or when a woman seeks treatment for a miscarriage, the hospital is required to provide a standardized form prior to discharge. This form will guide families on how to request a fetal death certificate or a certificate of birth resulting in stillbirth. "Families facing pregnancy loss are walking through one of the most difficult moments of their lives, and they deserve clear, compassionate communication from the moment they receive care," Roe stated. "This bill helps ensure they are informed about their options and supported as they navigate an incredibly personal experience."
In addition to providing written materials, the legislation mandates that hospital staff verbally inform patients and families about their ability to request these vital documents. This dual approach aims to eliminate confusion and ensure that families are fully aware of their rights and options during such a grieving process.
The Oklahoma State Department of Health will be responsible for developing and publishing the standardized form on its website, which will include clear instructions and contact information for the Division of Vital Records. This move seeks to create consistency across hospitals in Oklahoma, ensuring that no family leaves a hospital without knowing what resources are available to them. "This is about making sure every family is treated with dignity and given the information they need during a time of grief," Roe added. "By standardizing this process, we are helping provide clarity and support when it matters most."
Currently, Oklahoma faces a concerning infant mortality rate of 7.1 deaths per 1,000 live births, according to the March of Dimes 2025 Report Card. In 2023, there were 341 infant deaths before reaching their first birthday. These statistics highlight the critical need for comprehensive support and information for families dealing with pregnancy loss.
The bill passed unanimously in the House with an 89-0 vote, signaling strong bipartisan support for this important issue. If signed into law, SB 1436 has the potential to transform how Oklahoma hospitals support grieving families, providing them with both the emotional and informational resources they need during such a challenging time.
