Judge Shocks Everyone by Dismissing Election Challenge—What This Means for Pulkit Desai!

PARSIPPANY — In a significant ruling, a Superior Court judge dismissed a legal challenge to the recent mayoral election in Parsippany-Troy Hills, paving the way for Democrat Pulkit Desai to take office in January. The judge found that former Mayor James R. Barberio failed to provide adequate evidence to support his claims of voting irregularities.

On December 23, Judge Noah Franzblau dismissed Barberio’s verified election contest with prejudice, meaning it cannot be refiled. Additionally, he ordered Barberio to pay the prevailing candidate’s legal fees, emphasizing the lack of substantial evidence in Barberio's claims.

“(Barberio) has not provided either a certification or affidavit from any voter asserting that they did not execute and cast their ballot,”

Judge Franzblau stated in his written ruling.

In the November 4 general election, Desai won by a narrow margin of just 80 votes, signaling a pivotal shift in local leadership.

Legal Challenge Overview

Barberio, the Republican incumbent, initiated multiple post-election actions, including requests for a recount and a recheck of the ballots. However, his earlier petitions were thrown out by another judge due to procedural defects, notably failing to meet statutory deadlines. Subsequently, Barberio filed a verified contest alleging that illegal votes had been counted and that legitimate votes were unreasonably rejected. He also raised concerns about irregularities associated with mail-in, provisional, and in-person ballots.

Among Barberio's claims were:

  • Signature mismatches related to 33 provisional ballots and 122 mail-in ballots
  • Allegations that votes were cast in the names of deceased individuals
  • Claims that mail-in ballots missing required inner envelopes should have been counted

Judge Franzblau decisively rejected these allegations, highlighting that Barberio’s arguments were primarily based on “information and belief” without any sworn statements from voters asserting that their ballots were wrongly counted or cast. In fact, during oral arguments, Barberio’s attorneys conceded that they had not gathered statements from any of the specific voters named in the complaint.

Upholding Election Integrity

The court upheld the decision of election officials, who had properly rejected mail-in ballots that lacked inner envelopes, citing New Jersey statutes mandating signature verification. Without the required envelopes, Judge Franzblau noted, election boards are legally prohibited from counting those ballots.

Barberio’s claims that undelivered sample ballots indicated illegal voting were also dismissed. The judge pointed out that returned sample ballots can result from benign reasons such as voter relocation or postal issues, which do not inherently suggest fraud or misconduct. In several instances cited by Barberio, the voters identified had not participated in the election at all.

Under New Jersey election law, courts can award attorneys’ fees when an election contest lacks evidentiary support. Following the ruling, Raj Parikh, Desai’s attorney, has been directed to submit a fee application within ten days.

With the court ruling behind him, Pulkit Desai is set to be sworn in as the new mayor of Parsippany-Troy Hills on January 3, marking a new chapter in the town’s governance.
