Woman Sues Planet Fitness for $1M After Shocking Assault at West Ashley Gym - What Happened?

CHARLESTON, S.C. (WCSC) — A troubling incident has led to a lawsuit against Planet Fitness after an unidentified woman claims she was sexually assaulted at one of their gyms in West Ashley. The incident reportedly occurred on July 24, 2024, at the facility located inside the Citadel Mall.

According to the lawsuit, while the woman was using a Stairmaster machine, a man approached her and made comments about her appearance. The documents indicate that the man then followed her throughout the gym, even entering a reserved area designated for specific members.

Within this restricted space, the lawsuit claims the man physically pinned her down and sexually assaulted her, stating that there were no other individuals present and no surveillance cameras in the room. After the assault, the woman fled the gym, but later returned to inform the staff about the incident. Alarmingly, she was told that the assailant was a “known problem.”

Now, the woman, along with her attorneys from the Peper Law Firm, is seeking damages for negligence and emotional distress. Attorney Mark Peper emphasized the responsibility that businesses have to protect their patrons, stating, “Every business has a duty to protect their invited guests from known dangers. It’s the law of our state, and we expect companies to follow it. Today’s filing will hold Planet Fitness accountable for failing to protect this strong and courageous young woman, and we’re honored to represent her.”

As of now, Planet Fitness has not issued a public comment regarding the lawsuit.
