Paul Arnold, CEO of the ICO, emphasized the urgency of the situation, stating, “Our message to platforms is simple: act today to keep children safe online. There’s now modern technology at your fingertips, so there is no excuse not to have effective age assurance measures in place.” The regulators have set a deadline of April 30 for these companies to report on their progress in protecting minors.
This move follows a recent vote by British lawmakers against a blanket ban. Rather than isolating children from the internet, regulators are now advocating for enhanced enforcement of existing safety laws. The ICO has identified that many social media services, while setting a minimum age of 13, rely primarily on self-declaration for age verification. This method, which is easily bypassed, allows underage children to access platforms that are not designed for them, exposing them to potential risks.
The letter urges these platforms to implement modern age assurance technologies that have become increasingly available in recent years. Arnold pointed out, “New, viable age assurance technologies are now readily available. You should act now to implement them to enforce your own minimum age requirements.” Methods such as facial age estimation, digital ID verification, and one-time photo matching can help companies more accurately determine if a user is 13 or older, before allowing access to their services.
Arnold further noted that the current reliance on self-declaration is insufficient and should not continue as a primary mechanism for age verification. “Given the advances in age assurance technologies, we expect services to be making use of current viable technologies,” he said, reinforcing the expectation that platforms take immediate action to prevent under-13s from accessing their services.
The ICO's open letter outlines that if a platform is not suitable for children under a certain minimum age, it must implement an effective age gate to prevent access. This includes ensuring that any age assurance technology complies with data protection laws, which stipulate that data collected must be lawful, fair, proportionate, and minimal.
