TOPEKA, KS – In a decisive move that has sparked widespread outrage, the Kansas Legislature has overridden Governor Laura Kelly’s veto of Senate Bill 244 (SB 244), one of the most stringent anti-transgender laws in the United States. Advocates for LGBTQ+ rights have expressed deep concerns about the implications of this legislation on the lives and dignity of transgender Kansans.
The law mandates that state-issued birth certificates and driver’s licenses reflect only the sex assigned at birth, effectively invalidating previously issued documents that may reflect a person’s gender identity. It expands sex segregation requirements to various public facilities, including restrooms, hospital rooms, and domestic violence shelters. Violators of these provisions face civil penalties of up to $1,000 and potential criminal charges.
Micah Kubic, the Executive Director of the ACLU of Kansas, condemned the bill, stating, “This discriminatory bill undermines our state’s strong constitutional protections against government overreach and persecution. It subjects people to unacceptable privacy violations and puts them in harm’s way. Transgender Kansans should have protection and dignity in our state instead of persecution.”

Michael Poppa, Executive Director of the Mainstream Coalition, criticized the Legislature for focusing on targeting already marginalized communities while neglecting pressing issues like housing and healthcare. He stated, “That is not leadership, and it is not reflective of Kansas values. The elected representatives who lack the courage to stand up to this extremism should be ashamed—and must be held accountable in November.”
Taylor Morton, Legislative Affairs and Organizing Manager at Planned Parenthood Great Plains Votes, emphasized that the Legislature should prioritize the real needs of Kansans rather than attempting to dictate their identities. “SB 244 wrongly codifies gender as one’s sex assigned at birth and punishes transgender, nonbinary, and gender-diverse Kansans under the guise of protecting Kansans,” she said, highlighting the urgent need for access to healthcare and support for families.
